These are rather sombre questions to think about at Christmas time, but are very important considerations when you start your resolutions for the New Year. As life is full of many, often unforeseen events, if you aren’t actively addressing all of these questions, you and your family may not be fully taken care of.
For more than 125 years as an Authorised Trustee company, we’ve seen numerous cases where people want to protect and preserve their assets, and have taken some positive measures to do so, but they haven’t covered everything. And, as is often the case, these gaps became most obvious when people most need the protection – when they were sick, unable to make decisions for themselves and/or having their assets challenged.
These gaps may have resulted from a number of reasons - a lack of information, the use of multiple providers who don’t have a full view of a person’s needs, or to try to save money.
Am I up-to-date?
Ironically, if you don’t have an up to date will or an enduring power of attorney, resulting court costs and process become significant – eroding your assets or estate, delaying important medical and property decisions and placing a heavy burden on your loved ones.
We see many people, who have set up a will to preserve their estate when they die and protect their loved ones, but haven’t established enduring powers of attorney to benefit themselves while they’re alive.
Enduring powers of attorney allow you to nominate a trusted party to act for you in the case that you become incapacitated due to illness or are indisposed and unable to act.
